Applicant Terms and Conditions

“Competition” means name of local/regional competition(s) Associate manages and the VisitEngland Awards for Excellence

“Organiser” means name of Associate

“You” means the individual who submits an application

“Platform” means the online system that the applicant must use to complete their application.

By submitting an application to the Competition, you agree to be bound by the following terms and conditions:

  • Applications for the Competition must be from businesses located in England and within Cornwall and The Isles of Scilly.
  • Applications for the Competition must be submitted before the deadline stated on our website
  • Applications must be submitted online at cornwalltourismawards.org.uk
  • It is free to apply to all of the Competition categories.
  • The business/experience must be open at some point between 1st June 2025 and 31st October 2025, so the judges can visit if required. If you are due to be closed for any part of this period, please ensure this is highlighted in the ‘closures’ box on your application.
  • If required by the Organiser the business to which the application relates to will need to accommodate a judging visit. If a judging visit is not accommodated for any reason whatsoever this may result in the application being delayed and/or withdrawn.
  • The Organiser and VisitEngland reserve the right to amend the judging process at the time if circumstances make judging visits impractical.
  • Applications may be submitted by any individual representing the business to which the application relates to and the individual who submits the application will also become the contact whom all correspondence from the Organiser and VisitEngland concerning the Competition will be addressed to.
  • You must inform the Organiser immediately of any changes to the contact information relating to you or the business to which the application relates to during the Competition.
  • Individuals submitting applications on behalf of another business, must have the express permission of the owner or manager of the business the application relates to.
  • Employees or representatives/agents of the Organiser and VisitEngland are not eligible to submit an application to the Competition except for categories in which third party nominations are publicly invited.
  • The business to which the application relates to complies with all current and relevant legal and licensing obligations. The Organiser and VisitEngland reserve the right to not consider an application if this is in doubt and cannot be confirmed.
  • The business to which the application relates to operates ethically and is not involved in activity that could (or does) bring the visitor economy/ tourism industry/ Competition into disrepute. The Organiser and VisitEngland reserve the right to not consider an application if this is in doubt and cannot be confirmed.
  • You can apply for more than one category, except where specified within the eligibility criteria, but separate applications must be completed for each.
  • Applications will only be considered if they are deemed to meet the eligibility criteria.
  • Applications will only be considered if they are submitted via the Platform and completed in full and do not exceed the maximum word counts.
  • The Organiser reserves the right to move an application into a different category, if deemed more appropriate and should this occur you will be informed.
  • The business to which the application relates to, agrees will, if requested, reimburse the judge and his/her partner (or family/companions in the case of some visitor attractions or experiences) on departure for the cost of the mystery visit/overnight stay, any meals taken (alcoholic drinks only for Pub of the Year, Taste of England Award and Small and Large Hotel of the Year categories), or any admission or ticket cost as appropriate to the category.
  • The business to which the application relates to, agrees to be part of any publicity undertaken in association with the Competition. You accept and agree that the Organiser and VisitEngland may use or publish any photographs, comments or evidence submitted at any stage of the Competition in any media, waiving any rights to payment or to inspect and approve a finished product.
  • You confirm that you or business to which the application relates to own the copyright to any photographs included with your application.
  • The Organiser and VisitEngland may send you communications via email in relation to your application to the Competition e.g. reminders of the deadline and to submit your application, notification of successful application submission, judging feedback, applicant survey, event invitation.
  • The Organiser and VisitBritain/VisitEngland may store your contact information within databases to send you marketing communications including newsletters, future events and promotions unrelated to the Competition.
  • Competition judges may decline to award winners at any level in some or all categories, if in their opinion there are insufficient entries of a winning standard.
  • The prize provided by the Organiser for each winner will be a certificate and/ or a trophy. There is no cash alternative.
  • Competition winners may publicise their success indefinitely provided the placing, category and year are specified in all publicity and materials.
  • Competition winners may only use the specific logo issued by the Organiser or VisitEngland and not modify it in any way, nor use, or adapt for use, any other logo connected with the Organiser or VisitEngland.
  • The logo may only be used alongside the location or part of the business that has won an award e.g. a self catering provider with multiple properties across different locations must only use the logo alongside the winning location.
  • The Organiser and VisitEngland will not accept responsibility for applications delayed or lost as a result of any network, computer hardware or software failure.
  • In the event of any dispute regarding the Competition eligibility criteria, application forms, judging process, choice of finalists/winners or any other matter relating to the Competition, the decisions of the Organiser and VisitEngland shall be final and no correspondence or discussion shall be entered into.

ADDITIONAL TERMS

National Judging

  • Should the business to which the application relates to win an award in your local/regional Competition it may be automatically put forward for national judging by VisitEngland for the VisitEngland Awards for Excellence 2026.
  • You must notify the Organiser in writing at the time of application if you do not wish to be put forward for national judging
  • In rare circumstances VisitEngland may deem that an application does not meet the eligibility criteria and reserves the right not to consider the application for national judging
  • It is not possible to revisit your application prior to being put forward for national judging
  • VisitEngland reserves the right to move an application into a different category, if deemed more appropriate
  • The prize provided by VisitEngland for each winner will be a certificate and/ or a trophy. There is no cash alternative.
  • Any queries in relation to national judging should be directed to VEAwards@visitengland.org
  • Any data you provide will be handled in accordance with the Organiser’s privacy policy, VisitEngland’s privacy policy and the privacy policy of the organisation contracted to provide the Platform, available on their websites.
  • The Organiser reserves the right to make changes to these Applicant Terms and Conditions at any time and may notify you in writing of these changes.

Cornwall Tourism Awards Event Terms & Conditions:

We are Services For Tourism Limited (“we/us”), a registered company in England and Wales incorporated under company number 06560398. Our registered office is Suite B First Floor Tourism House, Pynes Hill, Exeter, Devon, England, EX2 5WS.  We host Events and operate a service to enable you to make a Booking as the Booker.  By making a Booking, you agree to these Terms which bind you.

1. Definitions
1.1 When the following words with capital letters are used in these Terms, this is what they will mean:

“Booker/you/your” the individual who makes the Booking Reservation.
“Booking” the confirmed reservation of the Event.
“Booking Reservation” the Booker’s request to book an Event via the online booking form available through the Website.
“Code of Practice” the Tourism Awards – Code of Conduct, found here and as updated from time to time.
“Contact Details” Email: awards@services4tourism.co.uk
“Event” the event in which you are making a Booking, details of which have been made available on the Website.
“Event Outside of the Parties’ Control” as defined in clause 9.2.
“Guest” the individual(s) attending the Event under your Booking (which may include the Booker).
“Privacy Policy” found here
“Substitution” the process of changing the identity of a Guest on a Booking.
“Terms” the terms and conditions on which your Booking Reservation is made, being this agreement and any other documentation referred to in it.
“Ticket Fee” the total price as charged to you for the Booking Reservation, as set out on the Website.
“Website” https://services4tourism.co.uk/

1.2 When we use the words “writing” or “written” in these Terms, this will include email but does not include fax or any messaging service or platform.
1.3 Unless the context otherwise requires, words in the singular shall include the plural and vice versa.
1.4 If any of these Terms conflict with any term contained within the Code of Practice, these Terms will take priority.

2. About These Terms
2.1 Please ensure that you read these Terms carefully, and check that the details on the Booking Reservation are complete and accurate, before you submit the Booking Reservation.
2.2 Once your Booking Reservation has been confirmed in accordance with clause 3.3, these Terms will become binding between us.
2.3 We may revise these Terms from time to time if required due to changes in the law or regulatory requirements or if business needs dictate it.
2.4 If we have to revise these Terms under clause 2.3, we will give you at least 14 days written notice of any changes to these Terms before they take effect, or as much notice as reasonably possible where your Event is less than 14 days before the date of the change.
2.5 You can choose to cancel the Booking if you do not accept these changes and will be refunded any monies paid to date in full.

3. Booking Your Place
3.1 Please take reasonable steps to ensure that the Event is suitable for your needs before submitting a Booking Reservation. If you have specific access requirements, please detail your requirements within the Booking Reservation. If you have any questions, please contact us using the Contact Details and we can discuss the suitability of the Event.
3.2 By making a Booking Reservation, you confirm that you (the Booker) are over the age of 18.
3.3 In order for us to confirm acceptance of your Booking Reservation, you must pay the Ticket Fee. We will not confirm acceptance until we have received payment of the Ticket Fee. Entry to the Event will only be accepted for Guests who have made payment of the Ticket Fee and received confirmation of acceptance from us.
3.4 We shall confirm acceptance of your Booking Reservation by email using the email you have provided in the Booking Reservation.
3.5 If we discover an error with your Booking or the Event, we will inform you as soon as reasonably possible and give you the option to confirm your Booking in its corrected state.
3.6 We reserve the right to refuse any Bookings that we no longer wish to take or are unable to supply within 7 days of the Booking Reservation. If your Booking is refused in accordance with this clause 3.6, you will be refunded any monies paid to date in full.

4. At The Event
4.1 By making the Booking Reservation and attending the Event, you and your Guests agree to adhere to the Code of Practice.
4.2 You and your Guests accept that we will not tolerate bullying, intimidation, verbal abuse or aggression of any kind, sexual harassment including but not limited to inappropriate or unwelcome comments, gestures or jokes, unwanted touching or suggestive behaviour, sharing explicit materials or images, discrimination or hate speech based on race, gender, age, disability, religion, sexuality, or any protected characteristic, or drunken or disruptive conduct that affects others’ enjoyment or safety.
4.3 A breach of the Code of Conduct and/or this clause 4 shall constitute a material breach of these Terms and may result in one or more of the following actions:
4.3.1 removal from the Event;
4.3.2 exclusion from future Events;
4.3.3 forfeiture from entering any of our awards;
4.3.4 termination of these Terms;
4.3.5 disciplinary action (if applicable); and
4.3.6 referral to the relevant authorities.

5. Payment
5.1 The Ticket Fee will be set out at the time of submitting your Booking Reservation and when your Booking is confirmed by us. You will receive a link to make a payment via the email you provided when making the Booking Reservation.
5.2 All payments are made by BACS transfer, debit card, credit card or cheque. We do not accept payments by cash. Where VAT is chargeable, we may send you an automatic VAT invoice.
5.3 We are not responsible for any incorrect payment details provided by you.
5.4 Any refunds given under these Terms will take up to 10 working days to be processed from the point of agreement.

6. Guest Substitutions and Booking Cancellations
6.1 You are permitted to make a Substitution at any time up until 24 hours before the Event at no extra charge. If a Substitution is requested after this, you may be subject to pay a £5.00 administration charge.
6.2 In order to make a Substitution, you must contact us in writing using the Contact Details and may be required to provide details of the Booking including the Guests involved in the Substitution. You must ensure any information provided is accurate and we shall not be responsible if this is not the case. Please note, we are only able to accept requests for Substitutions from you, the Booker, and not from other Guests.
6.3 Any changes to dietary requirements or accessibility requirements must be communicated to us no later than 1 week prior to the Event, in writing and via the Contact Details.
6.4 You may cancel a Booking at least 7 days before the Event by contacting us in writing using the Contact Details. Provided you have fully paid the Ticket Fee, if you cancel in accordance with this clause 6.3, you will be entitled to a full refund of the Ticket Fee minus a £10.00 administration charge and subject to your reasonable compliance with any of our requests to enable us to make the refund.
6.5 If you wish to cancel less than 7 days before the Event, you will not be entitled to a refund. We may, at our sole discretion, attempt to re-book your Booking. If we are able to re-book, we will be able to offer you a refund subject to any different in Ticket Fee and payment of a £10.00 administrative charge.

7. Programme Alterations
7.1 We reserve the right to alter the content and timing of the Event, the identity of the presenters, location and/or venue at least 7 days prior to the Event or as soon as reasonably possible where such changes occur less then 7 days prior to the Event.
7.2 If any alterations are made in accordance with 7.1, you can choose to cancel the Booking. Our cancellation policy at clause 6 will apply.
7.3 We will not be liable for any costs or losses incurred by you as a result of the alterations at clause 7.1.

8. Postponement or Event Cancellation
8.1 We may have to postpone or cancel an Event for any reason, including unavailability of venue, key personal or key materials that mean we cannot provide the Event. We will promptly contact you if this happens.
8.2 If we have to cancel an Event under clause 8.1 and you have provided any payment for the Ticket Fees, we will refund these amounts to you in full.
8.3 We may cancel the contract for your Event at any time with immediate effect by giving you written notice if you:
8.3.1 do not pay us when you are supposed to; or
8.3.2 break the contract in any other material way.
8.4 If we have to postpone or cancel an Event in accordance with clause 8.3 or for any other reason, you may not be entitled for a refund.
8.5 Unless explicitly stated, we will not be liable for any costs or losses incurred by you as a result of a cancellation or postponement in accordance with this clause 8.

9. Event Outside of the Parties’ Control
9.1 Neither party shall not be in breach of these Terms nor liable for delay in performing, or failure to perform, any of our obligations under these Terms if such delay or failure results from events, circumstances or causes beyond our reasonable control. In such circumstances, the time for performance shall be extended by a period equivalent to the period during which performance of the obligation has been delayed or failed to be performed. If the period of delay or non-performance continues for 14 days, the party not affected may terminate these Terms by giving 7 days’ written notice to the affected party.
9.2 An Event Outside of the Parties’ Control includes, but is not limited to, strike, civil unrest, civil emergencies, government prohibition or restriction on all or party of the economy or trade including local lockdown, pandemic, epidemic, environmental disaster, damage or demolition to the location of the Event, or electrical outage of the location of the Event.
9.3 If you are unable to attend the Event due to an Event Outside of the Parties’ Control, but the Event remains unaffected, we will not be liable to you for any costs or losses.
9.4 If we have to cancel an Event due to an Event Outside of the Parties’ Control, we will let you know as soon as possible and confirm the options available to you.

10. Legal Rights and Complaints
10.1 As a consumer, you have legal rights in relation to the Event where it is not offered to you with reasonable skill or care, or if the service provided to you is not as described. Advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards office. Nothing in these Terms will affect these legal rights. However, we ask that you contact us in the first instance using our Contact Details.

11. Our Liability to You
11.1 No party can exclude or limit in any way their liability where it is illegal to do so, and this contract does not seek to exclude or limit any liability which cannot be excluded or limited by law.
11.2 We do not have any responsibility or liability to you (other than as outlined below) for loss of or damage to any of your items, belongings, pets or vehicles, howsoever caused. This applies to you and your Guests.
11.3 If we fail to comply with these Terms, unless where explicitly stated otherwise, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence. We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of our breach or if it had been brought to our attention by you before the loss or damage occurred. For the avoidance of doubt, we are not responsible for any transport and/or alternative venue costs.

12. How We May Use Your Personal Information
12.1 We will use the personal information you provide to us to:
12.1.1 provide the Event,
12.1.2 process your payment for the Booking,
12.1.3 process identity checks where necessary, and
12.1.4 inform you about similar products or services that we provide, where you have permitted us to. you may stop receiving these at any time by contacting us.
12.2 All data you provide to use will be treated in accordance with our Privacy Policy.
12.3 We, and our contractors, will be taking photographs and filming throughout the Event. If you do not wish to be included please email us awards@services4tourism.co.uk or let us know on the evening. By attending the Event, you and the Guests agree, acknowledge and understand that photos and videos may be taken during the Event by either our contractors, us and other guests and will be shared on websites and on social media. Official photographs will be available for winners use the day after the awards via a link given in the awards app.

13. Other Important Terms
13.1 We may transfer our rights and obligations under these Terms to another individual, but this will not affect your rights or our obligations under these Terms.
13.2 Except for you (the Booker) and us, no other person shall have any rights to enforce any of these Event Terms.
13.3 Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
13.4 If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you (or if we delay in doing so) that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.
13.5 The validity, construction and performance of these Terms shall be governed by the laws of England and Wales and shall be subject to the exclusive jurisdiction of the courts of England and Wales to which the parties submit.

Keeping Safe If you have an infectious disease or symptoms of Covid-19 please do not attend but feel free to give your ticket to someone else just let us know who this will be. Any refunds are at the organisers’ discretion.  Should you become unwell at the event please find one of the events team who will be able to help and get a first aider if required. We can also ensure your award is collected in the unlikely event that you have to leave.
